Senator Ngo calls for the immediate release of Tran Huynh Duy Thuc

Today, Senator Thanh Hai Ngo issued the following Statement in response to reports of prisoner of conscience Tran Huynh Duy Thuc’s intentions to resume his hunger strike (his third since the end of 2020) should the appeal to end his illegal 16-year prison term be rejected.
This once successful engineer and entrepreneur, was arbitrarily detained in May 2009 and initially charged with ‘theft of telephone wires’; which later was changed to an indictment under Article 79 of Vietnam’s Penal Code for ‘subversion’ or ‘activities aimed at overthrowing the people’s administration’ handing him a sentence of 16 years of imprisonment. Having served almost 12 years of the 16-year sentence, he is urging the High Court to consider his request to have it reduced in accordance with the new Penal Code of 2015 –which now carries a maximum term of 5 years in prison and which no longer considers his ‘crime’ as ‘subversion’. Mr. Thuc, who remains steadfast in his conviction that freedom of speech is not a crime, is prepared to die of hunger if the ‘subversion’ charge is not reassessed and reduced.
While Tran Huynh Duy Thuc is literally at the brink of death, prison authorities, the judiciary and high officials continue to turn a deaf ear to his plight and that of hundreds of other prisoners of conscience unjustly and arbitrarily detained simply for peacefully exercising their fundamental rights and freedoms enshrined in the Universal Declaration of Human Rights and in two international treaties – the International Covenant on Civil and Political Rights and the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, ratified by Vietnam in 1982 and 2015, respectively.
Mr. Thuc’s tragic predicament is not isolated and represents the collective plea for justice of all those unjustly incarcerated by this criminal and cruel socialist system. In the eventual death of Tran Huynh Duy Thuc – and all those who perish at the mercy of the Vietnamese government’s colossal failure to uphold its international obligations – officials responsible should be brought before the International Criminal Court, held criminally liable and indicted under the full force of international law.

Aujourd’hui, le sénateur Thanh Hai Ngo a publié la déclaration suivante en réponse aux informations faisant état de l’intention du prisonnier d’opinion Tran Huynh Duy Thuc de reprendre sa grève de la faim (sa troisième depuis la fin de 2020), et ce, si l’appel visant à mettre fin à sa peine illégale de 16 ans de prison est rejeté.
Cet ingénieur et entrepreneur, autrefois couronné de succès, a été détenu arbitrairement en mai 2009 et initialement accusé de “vol de fils téléphoniques”, infraction qui a ensuite été transformée en un acte d’accusation au titre de l’article 79 du Code pénal vietnamien pour “subversion” ou “activités visant à renverser l’administration populaire”, lui valant ainsi une peine de 16 ans d’emprisonnement. Ayant purgé près de 12 ans de sa peine, il demande instamment à la Haute Cour d’examiner sa demande de réduction de la peine conformément au nouveau Code pénal de 2015 – qui prévoit désormais une peine maximale de 5 ans d’emprisonnement et qui ne considère plus son “crime” comme de la “subversion”. M. Thuc, qui reste fermement convaincu que la liberté d’expression n’est pas un crime, est prêt à mourir de faim si l’accusation de “subversion” n’est pas réévaluée et réduite.
Alors que Tran Huynh Duy Thucest littéralement à deux doigts de la mort, les autorités pénitentiaires, le pouvoir judiciaire et les hauts fonctionnaires continuent de faire la sourde oreille face à sa détresse et à celle de centaines d’autres prisonniers d’opinion, qui sont injustement et arbitrairement détenus simplement pour avoir exercé pacifiquement leurs droits et libertés fondamentaux consacrés par la Déclaration universelle des droits de l’homme et par deux traités internationaux – le Pacte international relatif aux droits civils et politiques et la Convention contre la torture et autres peines ou traitements cruels, inhumains ou dégradants, ratifiés par le Vietnam en 1982 et 2015, respectivement.
La situation tragique de M. Thuc n’est pas un cas isolé, mais plutôt représente le plaidoyer collectif pour la justice de toutes les personnes injustement incarcérées à cause de ce système socialiste criminel et cruel. Dans l’éventualité de la mort de Tran Huynh Duy Thuc – et de tous ceux qui périssent à la merci de l’échec colossal du gouvernement vietnamien à respecter ses obligations internationales –les responsables devraient être traduits en justice devant la Cour pénale internationale, tenus criminellement responsables et inculpés en vertu du droit international avec toute la rigueur qui s’impose.
